By accessing LucidBeing (the "Platform"), whether as an individual or on behalf of an educational institution (the "Client"), the user agrees to be bound by these Terms governed by the laws of India.
LucidBeing is an AI-powered educational tool designed to assist with resume analysis, interview preparation, and curriculum generation.
Contractual Non-Training Assurance
LucidBeing contractually guarantees that all user data processed through its AI infrastructure is handled via Enterprise-grade, zero-retention channels. Unlike public consumer AI interfaces, user inputs (including resumes and interview recordings) are legally excluded from being used by foundational model providers for machine learning training. Any AI-generated output is provided 'AS IS' for preparatory purposes, and LucidBeing maintains strict data isolation to ensure institutional confidentiality.
LucidBeing retains all rights, title, and interest in the Platform, including its code, algorithms, UI/UX, and proprietary prompts. The Client/User retains ownership of the input data (e.g., uploaded resumes). LucidBeing grants the Client a limited, non-exclusive license to use the generated output for internal educational purposes.
The Platform relies on third-party infrastructure (e.g., Google Cloud, Cloudflare, Gemini APIs). LucidBeing is not liable for service interruptions, 503 errors, or downtime caused by these external providers.
The Client agrees not to reverse-engineer the Platform, attempt to extract the underlying AI prompts, or use the service for any unlawful purpose.
Fees are charged as per the executed Order Form or Enterprise Agreement. All fees are non-refundable unless explicitly stated in the specific B2B contract.
To the maximum extent permitted by applicable Indian law, LucidBeing’s total liability for any claims arising under these Terms shall be limited to the total amount paid by the Client to LucidBeing in the twelve (12) months preceding the event giving rise to the claim.
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
